Progressive Discipline

A Smarter—Fairer—Disciplinary Policy

Progressive discipline refers to a disciplinary system with escalating penalties upon each repeat offence. Designed to mitigate offences, it helps you manage discipline without being overly punishing.

Upon first offence, the employer might give a member of staff a verbal warning. If the employee repeats the offence, the penalty may escalate to a more serious disciplinary action, such as a written reprimand. Finally, if the offence continues, the employer may resort to suspending or terminating the employee.

Progressive discipline ensures staff members have ample room to learn and grow from their mistakes. It seeks to reduce offences but focusing on teaching, not punishing. It also provides a clear framework to document offences to protect the employer in case of dispute.

Problems We See Regularly

The Employer gives the employee a series of verbal warnings and does not keep a record of these warnings. After a while, the Employer can no longer tolerate the inappropriate behaviour of the Employee and decides that they want to terminate him/her. They consult their lawyer and realize they did not apply progressive discipline. All of a sudden the Employee is bombarded with written reprimands, suspensions without pay and then termination all within a very short period of time. This is the WRONG WAY to apply progressive discipline and it can be costly to proceed in that fashion.
